Everyone in my company is waiting patiently for the "MEMO on 13th Month Salary". Actually, I think all of us are deserve for the 13 month.
I have review the contract but there is an ex-gratia term which means there was no obligation for the company to paid the 13 month. By stated this in the contract, this just simply means that 13th month have become a type of bonus and not entitlement for employee.
There is some company does not implement the 13th month bonus for their emploeyees but there will paid higher monthly salary due to the company have factor in the 13 month. Do you think no increment and year end bonus because of the current economic situation is fair for all of us?
